A Brief History of Asbestos

April 2nd, 2011

Asbestos is a naturally-occurring fibrous mineral of metamorpic hydrous magnesium silicate. The term “metamorphic” is used to describe a process of extreme heat and pressure which creates specific secondary patterns of minerals with new chemical and/or physical properties.

As the primary rock is heated and recooled, silicate crystals align in long rows of mineral fibers, which easily separate into tiny shards thinner than a human hair. Asbestos fibers are not a health risk as long as they are undisturbed. However, when asbestos is undergoes natural weathering, or is mined and processed, the microscopic particles waft into the air and cause disease if they are inhaled.

Asbestosis occurs when an inhaled asbestos particle irritates the body’s natural defence mechanisms, causing inflammation and scarring which eventually restricts lung function. Mesothelioma is a malignant tumor of the membranes surrounding the heart, lungs and abdominal cavity. Asbestos can also cause cancer of the mouth, throat, esophagus, larynx, stomach, lung and lymphoid tissue.

Asbestos exposure can also cause non-fatal illnesses such as asbestos warts, caused when asbestos fibers are lodged in the skin, causing lumps of scar tissue to form around the irritant in the same manner as they do in the lungs to cause asbestosis; pleural plaques, discrete, sometimes calcified fibrous lesions which can be seen on X-rays but are too small to cause breathing impairment; and diffuse pleural thickening, which can cause breathing impairment if it is extensive.

Due to its fire resistant properties, asbestos has been used historically for household and industrial purposes. It has been found woven into burial cloths in ancient Egypt, and Charlemagne reportedly had a tablecloth made of asbestos which he would throw into a fire to clean.

In World War II asbestos was considered so important by the War Department that it was considered a strategic material, and many American workers were exposed in the World War II boom in shipbuilding. After the war, it was widely used in the construction industry.

In modern Western society, it was used for such diverse purposes as lamp wicks, brake shoes, oven insulation, electrical hotplate wiring and home insulation, roofing and flooring. For instance, some kinds of vermiculite used in home insulation into the 1970s contained asbestos. The EPA banned this product in 1977.

When a home owner discovers asbestos in an old home, it should not be a cause for immediate panic. If the asbestos looks intact and is not pulverised, it is best to leave it alone. However, because of legal liability, schools and businesses containing asbestos usually must undergo a costly removal process, hazardous in itself because disturbing the stable asbestos product causes fibers to fill the air. Special equipment must be used to insure that the removal process does not cause health problems where non existed before.

Most industrialised nations have reduced or banned the use of asbestos for at least 30 years and now use fiberglass or woven ceramic fiber as a substitute, but since asbestos-caused disease has a latency period of up to 50 years, patients are still presenting with these illness today. Every year in America, approximately 3000 new cases of mesothelioma are diagnosed, and 550 deaths occurs due to asbestosis. According to the March 1991 Report of the Judicial Conference Ad Hoc Committee on Asbestos Litigation, asbestos exposure has caused the deaths of approximately 200,000 to 265,000 Americans.

Asbestos use peaked in the United States in 1973, when 1 million tons of the material were used. The EPA attempted to institute a complete legal ban on the use of asbestos products in 1989; however, this ban was largely eviscerated by the US 5th Circuit Court of Appeals in 1991, and some restricted use of asbestos, albeit in fewer products than before, resumed. Therefore, even today some workers are being exposed to this toxic material.

Asbestos is a serious continuing concern to the Environmental Protection Agency, and their website has detailed information on asbestos and its removal.

Concerns about the health risks of asbestos exposure date back to 1898, when the Chief Inspector of Factories of the United Kingdom reported to Parliament in his Annual Report about the “evil effects of asbestos dust”. He noted that the “sharp, glass like nature of the particles” when allowed to remain suspended in the air, “have been found to be injurious, as might have been expected”. In 1906 a British Parliamentary Commission confirmed the first cases of asbestos-related deaths in British factories and called for improved ventilation and other safety measures. In 1918 an American insurance company produced a study showing premature deaths in the asbestos industry in the United States and in 1926 the Massachusetts Industrial Accidents Board processed the first successful claim by a sick asbestos worker.

Today, lawsuits claiming compensation for asbestos-related illnesses are a growth industry in the legal profession. An internet search of “mesothelioma lawyer” yields 1,910,000 results. The original manufacturers of asbestos products have long since been driven into Chapter 11 bankruptcy; plaintiffs have now turned to suing corporations with peripheral connections to asbestos products. More than 70 American corporations have filed Chapter 11 bankruptcy in due to asbestos liability claims.

Since the 1970’s, approximately 6% of all lawsuits filed in American courts have been asbestos-related. The lawsuits now facing the courts have been described as “an elephantine mass” by the US Supreme Court, and are expected to cost between 200 to 275 billion dollars to settle. Asbestos liability is one of the largest issues facing the global insurance industry today.

Most epidemiological studies expected the number of lawsuits to peak in the 1990s, but this has not occurred, either because of the long latency period of asbestos-related diseases, or because legal action is becoming more popular among asbestos-exposed members of the public due to high-profile legal cases and widespread advertising by attorneys who specialize in such cases.

Many complaints have been made by representatives of industries facing lawsuits and the insurance companies who will be expected to pay them that the asbestos-lawsuit industry is rife with fraud, with less that half of all payouts reaching the plaintiffs. Aggressive, ambulance-chasing lawyers are said to exaggerate medical disability and coach clients on their testimony.

The group of plaintiffs includes not only ill people, but also those who have merely have a history of asbestos exposure and want compensation for potential future health risks. According to the American Academy of Acturaries Mass Tort Work Group, more than 100 million Americans have been exposed to asbestos in their workplace during the past century.

What is the Role of Meditation in Mesothelioma Treatment?

April 2nd, 2011

Meditation is a mind-body process that uses concentration or reflection to relax the body and calm the mind. It has been defined as the intentional self-regulation of attention, a mental focus on a particular aspect of one’s inner or outer experience.

Meditation is one of several relaxation methods evaluated and found to be of possible benefit to people living with cancer it might be a useful complementary therapy for treating chronic pain and sleeping problems such as insomnia that are sometimes associated with mesothelioma cancer .

Some mesothelioma cancer treatment centers offer meditation or relaxation therapy with standard medical care. Available scientific evidence does not suggest that meditation is effective in treating mesothelioma or any other disease however, it has however been found to improve the quality of life of people with mesothelioma cancer.

It has been recorded that regular meditation can reduce chronic pain, anxiety, high blood pressure, cholesterol, substance abuse, post-traumatic stress disorder , and blood cortisol levels that are increased by stress (sometimes called “stress hormones”).

Practitioners also claim meditation improves mood, immune function, and fertility. Supporters further claim meditation increases mental efficiency and alertness and raises self-awareness, all of which contribute to relaxation.

There are different forms of meditation. Meditation may be done while sitting, but there are also moving forms of meditation, like tai chi, qigong, walking, and the Japanese martial art aikido. One commonly practiced type is Transcendental Meditation, which involves repeating a word or phrase, called a mantra, either silently or aloud. Another is mindfulness meditation, in which a person observes sensations, perceptions, and thoughts without judgment as they arise. There are other types of meditation that focus one’s attention through walking or visualizing.

Meditations that focus on words or images and do not strive for a state of thoughtless awareness are sometimes called quasimeditative. Meditation can be self-directed, or guided by doctors, psychiatrists, other mental health professionals, or yoga masters. It can also be guided by masters from different schools of meditation (for example, Zen meditation, Tibetan meditation, Transcendental Meditation), as well as those from tai chi and martial arts.

Meditation may be done by choosing a quiet place free from distraction, sitting or resting quietly with eyes closed, noticing one’s breathing and physical sensations, and letting go of all intruding thoughts. The person may also achieve a relaxed yet alert state by focusing on a pleasant idea or thought, or by chanting a phrase or special sound silently or aloud. The ultimate goal of meditation is to separate oneself mentally from the outside world by suspending the usual stream of consciousness. Some practitioners recommend two sessions of fifteen to twenty minutes a day.

In the last twenty years, meditation has been studied in clinical trials as a way of reducing stress on both the mind and body. Research shows that meditation can help reduce anxiety, stress, blood pressure, chronic pain, and insomnia.

Studies of mindfulness meditation found that it seemed to help with symptoms of anxiety.

Studies have shown that meditation reduces the symptoms of stress and emotional disturbance in mesothelioma patients. Some studies have also suggested that more meditation improves the chance of a positive outcome for the cancer patients.

Complications are rare, however, a small number of people who meditate have become disoriented or anxious and experienced some negative feelings. People with certain types of mental illness may be more likely to have these responses. You should talk with their doctors before starting any type of meditation that involves movement of joints and muscles, such as qigong or martial arts.

In conclusion, even if you decide to start meditation you should not abandon your conventional medical care for mesothelioma cancer as this might lead to bad outcome for you.

The relationship between mesothelioma, asbestos and cancer

April 2nd, 2011

The history of asbestos

Asbestos generally refers to long threads of silicate fiber compounds. The word asbestos actually comes from the Greek word for “inextinguishable” as they are resistant to heat, fire, and chemicals as well as non-conductive. These unique properties made asbestos a useful material in many industries including the shipbuilding, automobile, and construction industries.

In America, they were first mined and used commercially during the late 1800s, gaining popularity until the 1970s. It was then that the use of asbestos was finally banned for certain uses as the health hazards came to the forefront, including manufacturers of electric hair dryers.

In 1989, the Environmental Protection Agency (EPA) banned all new uses of asbestos; previously established uses, however, were still allowed. This was intended as a way to slow and then eliminate the use of asbestos in the United States, however it was overturned in 1990. Also in 1989, regulations regarding damaged or exposed asbestos in schools are also established.

Even today asbestos can be found in many products including:

- brake pads and shoes,

- roofing tar and roof shingles,

- caulk,

- clutch plates,

- fire blankets,

- the fireproof clothing worn by firefighters, and

- thermal pipe insulation.

Linking asbestos to cancer

Asbestos poses the greatest threat to those who work with it regularly as they are most likely to inhale the fibers. When asbestos is disturbed, as may occur when it is being fitted for a particular use such as insulating a section of piping or wall, the smaller fibers break off and become airborne. In this form, the people around them can easily inhale the asbestos fibers.

Once inhaled, the asbestos lodges within the lungs and causes irritation, scarring, and possible abnormal cell growth, resulting in tumors and cancer as well as other mesothelioma symptoms. Asbestos cancer is also referred to as mesothelioma, because it affects the lining of the body’s organs which is called mesothelium.

Workers in the following trades have the greatest risk of being exposed to asbestos and developing mesothelioma:

- Asbestos mining and milling

- Shipbuilding

- Construction/building, particularly working with insulation

- Asbestos removal workers

- Automobile workers

- Firefighters

- Asbestos textiles manufacturing

Mesothelioma Cancer Treatments

April 2nd, 2011

As mesothelioma is a type of cancer the treatments that are used to combat this disease are very much like the ones used to fight the more common forms of cancer. However, we need to take into consideration different factors when treating cancer patients. These are as follows: the age of the patient, his/her medical condition and health situation, the extent of the disease and lastly the seriousness of it. Common ways to treat Mesothelioma cancer are surgery, radiotherapy, palliative therapy, chemotherapy or a combination of the above mentioned treatments.

We generally find that the most common form of treatment for patients with mesothelioma is surgery. This usually entails removing the abdomen and its surrounding tissue. Pleural mesothelioma on the other hand involves a process called pneumonectomy and the patient’s lung is removed along with part of the diaphragm and nearby lung tissue.

Chemotherapy
Chemotherapy, which most people will have have heard of involves treating the cancer with anti-cancer drugs that are injected into the patient’s body to seek out and destroy cancer cells throughout. This method is often used when the cancer has spread out to a larger area of the patient’s body.

Radiotherapy
Treatment of this type of cancer by radiation is referred to as Radiotherapy. Radiation is produced by advanced medical equipment that uses these high energy x rays to wipe out malignant cancer tumors or destroy cancerous cells in the areas to be treated. Normal cells are destroyed along with this process.

Palliative therapy
Palliative therapy is treatment that is given to help control or reduce symptoms caused by the cancer. It often involves the use of suction and needle to drain away excess fluid from the lungs of the patient. The main purpose of palliative therapy is to improve the patient’s comfort and quality of life. Depending on the circumstances of each patient, palliative therapy may be given in combination with other treatments intended to cure the disease or on its own when a cure is not possible.

A combination of the above treatments are often used when dealing with sufferers of mesothelioma. They are however, typical cancer treatments and at times not suitable for mesothelioma sufferers. Clinical trials are often suggested to patients who suffer from mesothelioma and these are run by professionals in the field of mesothelioma research.Clinical trials are conducted
to allow safe and efficient data to be collected for new drugs or devices. Many patients look forward to the day when effective treatments are discovered that can treat this deadly disease known as mesothelioma.

(ArticlesBase SC #610776)

Toxic tort law cases are generally just massive personal injury cases in which the injury is caused by exposure to a toxic substance or chemical and generally in which scores, hundreds or thousands are injured. Sources of toxic substances include pharmaceuticals, consumer products, and substances found in the home, the air, the water, the soil and elsewhere in our environment.

Once you know that, you can see how we are all so vulnerable to toxic exposure. It has come to the point where almost all of us are or know someone else who has been exposed to things like asbestos, dangerous drugs, contamination of our water supply, or toxic dumping.

Whether you live in the mountains in Big Bear or Idyllwild, in Carlsbad, OceansideChula Vista or El Cajon in San Diego, in Newport Beach, Huntington Beach, Anaheim, El Toro or Dana Point in Orange County, near Fullerton, Fontana, Ontario or Rancho Cucamonga in the Inland Empire, or anywhere from Palm Springs to Palm Desert, Coachella, Yucca Valley, Joshua Tree or Thermal in the Coachella Valley, or Brawley or El Centro in the Imperial Valley you may have been exposed to toxic chemicals.

In the news nearly every day are stories of mass torts involving dangerous chemicals in baby formula, or pet food, ice cream bars, milk, candy, baby cereal or cheese. Recently, there have been dangerous products coming out of China and Mexico, but fertilizer use in agriculture in the U.S. and the raising of other farm animals on a massive scale is an equally dangerous condition for the environment. It may sound funny, but gas emissions from cows are a real barrier to solving global warming and emerging countries like China with a growing desire for meat are adding to that problem.

Some toxic torts are difficult to pin the blame on any one defendant. Mercury in fish is an example. It is abundant. It is toxic. And it has far too many causes over far too many years to now blame one company or one country even over another. However, with new rules such as the new Country of Origin labeling law in states like California, in the future it may be possible to trace foodborne illnesses to certain farms and distributors.

In agricultural areas of California including Orange County, Central California, the Central Coast, San Diego County and the Coachella Valley, toxic tort exposure is a real concern. Sadly, many of the workers most likely to be exposed to such chemicals have the least exposure to quality medical attention or lawyers.

As years go by, we will find that many of the common items we encounter on a daily basis and take for granted are exposing us to serious danger. Add to that, one-time exposures by tainted food or milk, longer term exposures when the air, water or soil are contaminated and it is no wonder we fight so much disease and sickness in our lives.

Toxic tort lawyers can redress these problems when people come to us with their suspicions, stories of their symptoms and treatment, and we find either the causes or patterns of symptomology.

If you think you’ve been injured as the result of a toxic substance, speak to a toxic tort attorney immediately. If you suspect you have a toxic tort legal matter in Orange County, San Diego, in Riverside, Palm Springs or anywhere in Southern California, we have the knowledge and resources to be your California Toxic Tort Lawyers, and Orange County and San Diego Toxic Tort Attorneys. Cancer Incidence Among Workers Resulting from Exposure to Asbestos Dust and Fibers

April 2nd, 2011

Some occupations are considered more dangerous when it comes to asbestos exposure.  For example, people working as pipefitters, plumbers, and electricians suffer from an inordinate rate of mesothelioma disease.  This has been the subject of a great deal of research.  One interesting study is called, “Asbestos exposure, smoking habits, and cancer incidence among production and maintenance workers in an electrochemical plant” by Bjorn Hilt, MD, Sverre Langad, MD, MSc, Aage Andersen, Jan Rosenberg, MD – Department of Occupational Medicine, Telemark Sentralsjukehus, Porsgrunn, Norway, Cancer Registry of Norway, Montebello, Oslo, Norway, Health Department, Norsk Hydro A.S., Porsgrunn Fabrikker, Porsgrunn, Norway – American Journal of Industrial Medicine – Volume 8 Issue 6, Pages 565 – 577.  Here is an excerpt: “Abstract – The incidence of cancer was studied in a cohort of 287 men who were exposed to asbestos at a nitric acid production plant from 1928 onwards. During the observation period from 1953 through 1980 all cancer cases among the cohort members were identified in The Cancer Registry. For the whole cohort 42 cases of cancer were observed versus 30.6 expected. The figures for cancer of the lungs and pleura combined were 17 observed versus 3.7 expected. The corresponding figures for a heavily exposed subcohort were 11 observed and 1.2 expected. In that group there was also an increased incidence of colon cancer with 3 cases observed against 0.8 cases expected. Within the whole cohort four cases of pleural and one case of peritoneal malignant mesothelioma were found. There was also an increased incidence of malignant melanoma of the skin with 3 cases observed against 0.6 expected. For cancer cases that were registered as of unknown origin there were 7 cases observed and 1.4 expected. There was no increased rate ratio for cancer at any site before 20 years after the first asbestos exposure. The smoking habits of all cohort members were recorded and the relative rates for lung cancer were calculated in relation to smoking habits. In common with previous studies the results indicate a multiplicative model for the interaction between asbestos exposure and smoking in regard to lung cancer risk.”

Another interesting study is called, “Tests for effect of asbestos on benzo(a)pyrene carcinogenesis in the respiratory tract” by Miller, L.; Smith, W.E.; Berliner, S.W.
Publication Date 1965 Jan 01 – Ann. N.Y. Acad. Sci.; (United States); Journal Volume: 132.  Here is an excerpt: “Hamsters were given 25 intratracheal injections of 0.5 mg benzopyrene (BaP) in Tween-60 with or without 0.25 mg chrysotile (Chrys) asbestos. 173 to 214 days after start of injections, 4 tumors in 3/5 surviving animals subjected to BaP alone were found whereas 7/7 (15 total) were found in those given BaP plus Chrys. Three of these were larger than 3 mm. Animals given Chrys or Tween alone or control animals had no tumors. 16 injections of 0.5 mg BaP in Tween-60 with or without 2.5 mg amosite (AM) asbestos were given to hamsters. 29% of group given BaP and 26% of group given BaP plus AM had tracheobronchial tumors when sacrificed at day 240. One form of asbestos synergistically increased carcinogenic activity of BaP. Yield of tumors decreased with time after discontinuation of injections suggesting reversible action.”

Another interesting study is called, “DNA single strand breaks induced by asbestos fibers in human pleural mesothelial cells in vitro” – Environmental and Molecular Mutagenesis
Volume 33 Issue 2, Pages 153 – 160.  Here is an excerpt: “Abstract – The mechanisms of the cellular effects and DNA damage caused by asbestos fibers in human mesothelial cells are not well understood. We exposed transformed human pleural mesothelial cells to 1-4 g/cm2 crocidolite and to 10-100 ng/ml tumor necrosis factor alpha for up to 48 hr and studied the induction of DNA damage using the Comet assay. As a positive control, 100 M H2O2 was used. The DNA single strand breaks were assessed as the mean tail moments and as distributions of the tail DNA in the cell. The Comet assay showed significant but reversible increases in the mean tail moments, but not in the distribution of Comet tails in the histograms in cells exposed to 1 g/cm2 crocidolite for 6 hr. At higher concentrations of asbestos fibers all the indices in the Comet assay showed significant and irreversible change. All the doses of TNF- caused marginal increase in the mean tail moments. The mean tail moments were highest in the cells with concurrent treatment to TNF- and crocidolite. In the cells pretreated with inhibitors of antioxidant enzymes (aminotriazole for catalase and buthionine sulfoximine for -glutamylcysteine synthetase) asbestos fibers slightly increased oxidant-related fluorescence of dichlorofluorescein (DCFH) but did not cause any further increases in the mean tail moments. This study shows that asbestos fibers cause DNA single strand breaks in human mesothelial cells. Since the inhibition of antioxidant enzymes did not have an effect on the DNA damage caused by the fibers, other mechanisms than free radicals seem to be involved in the induction of DNA damage by mineral fibers.”

If you found any of these excerpts interesting, please read the studies in their entirety.

Mesothelioma Settlements Allow Victims to Cope

April 2nd, 2011

The diagnosis of mesothelioma is one that is difficult to grasp and accept. Mesothelioma is a rare form of cancer that attacks the mesothelium surrounding certain organs, particularly the lungs. Mesothelioma is most often seen in people with prolonged asbestos exposure.

If mesothelioma is diagnosed, it is possible to receive standard cancer treatments such as radiation, chemotherapy, and surgery. A good way for mesothelioma victims to cope with this devastating cancer is to file for a mesothelioma settlement.

A mesothelioma settlement may help more than a single victim. If one person has been diagnosed with mesothelioma then chances are others are experiencing illness due to asbestos exposure in the workplace. Each victim deserves the money awarded in a mesothelioma settlement. It can also help victims to cope by realizing that they aren’t alone; others are suffering the same fate and are also seeking a mesothelioma settlement themselves.

It is possible to file a class action lawsuit with several plaintiffs to offset the expenses of legal representation and receive a sizeable mesothelioma settlement.

The process of diagnosis and treatment of mesothelioma is long and draining. It is impossible to carry on a “normal” life. It is impossible to continue to work and receive that all-important paycheck. A mesothelioma settlement will provide much-needed funds during this time so a victim can seek out all possible treatment without adding money worries to the equation. Again, it is wise to have an attorney representing you in any type of mesothelioma settlement.

It is difficult for anyone to be confronted with a cancer diagnosis. However, most cancer patients are unable to place blame on a specific cause and receive a settlement, whereas a mesothelioma victim has the opportunity to file for a mesothelioma settlement.

It is the responsibility of the employer to payout a mesothelioma settlement when they are negligent. Most employers will recognize their fault, and in attempt to keep it as quiet as possible, will reach a mesothelioma settlement before the lawsuit reaches court. Your attorney will make certain that you receive all funds that help you through this difficult time in your life.

Thus, the first step after receiving a mesothelioma diagnosis is to seek a mesothelioma settlement. A mesothelioma settlement will allow the victim to receive the best possible treatment and help mesothelioma victims cope with their illness by giving them the opportunity to take the time to be with loved ones and join support groups. A mesothelioma settlement will make it easier to cope with this rare form of cancer.

Workers Compensation Attorneys

April 2nd, 2011

When an employee suffers an on the job injury, they may elect to have a workers compensation attorney handle their claim.  Typically workers compensation attorneys handle cases involving industrial injuries, occupational disease claims, rejected claims and pursuit of acceptance of conditions related to the original industrial injury or occupational disease.  A good workers compensation attorney will be able to determine that all monetary benefits that an injured worker is entitled to are paid correctly.  Claim issues that may arise requiring a workers compensation attorney may include termination of time loss compensation, payment of loss-of-earning-power benefits, payment of permanent partial disability awards, aggravation or worsening of the on job injury, or total permanent disability benefits.

A good workers compensation attorney can make a significant impact on the amount of recovery an injured worker receives for their on the job injury claim.  Workers compensation attorneys typically charge the injured worker on a contingency fee basis usually between 33-1/3 and 40% of the additional recovery made plus costs.  For example, if a workers compensation attorney charging 33-1/3% was able to obtain an additional $10,000 for an injured worker, the amount the injured worker would receive would be reduced by $3,333.33 for attorney fees plus costs an additional amount for attorney costs.  Workers compensation laws vary from state to state and on a federal level so it is best to consult with an attorney with expertise handling cases in your state.

Most employee workers compensation attorneys offer a free initial consultation to discuss a claim.  A workers compensation attorney can help ensure an employee’s rights are protected, that they are compensated for all benefits they are entitled to under state and federal laws, and help put the injured worker at ease with respect to how their claim is being handled.  Further, a workers compensation attorney may be able to identify additional legal remedies or benefits that the worker may be entitled to as a result of their on the job injuries.

Employees need to be aware that there on the job injury may have special protection under the law.  For example, if an employee is injured while operating faulty equipment, due to contractor negligence or employer ignored safety requirements, they may be to pursue punitive or general damages for their claim.  For example, if a construction worker is injured as the result of the negligence of another contractor on a job (not their employer), they may be able to bring third-party tort claim against the contractor.  Such examples would include leaving debris on a construction site, installing dangerous temporary electrical wiring, or backing a truck into a worker.  A further example would be when a subcontractor fails to install proper protective safety barriers when a scaffold falls.  Such incidents can cause catastrophic injury or death.  An employee who suffers an injury involving a third party should consult with an experienced personal injury attorney who has handled similar cases.

If a worker’s injury is the result of a defective product, they may also be able to pursue a product liability claim.  Examples would include a defective forklift, defective scaffolds, or a saw without safety guards.  Employees injured working in these industries should consult with an experienced injury attorney.

Employers and their insurers also have the right hire an attorney or have their own in-house counsel for a workers compensation claim.  Typically, the employer or their insurer will only hire a defense attorney when a claim is litigated.  To avoid incurring legal expenses, the employer’s insurer will sometimes refer the case to defense counsel just prior to court deadlines.

The Seriousness Of Mesothelioma

April 2nd, 2011

A Mesothelioma diagnosis is never a good one to get. It is a very dangerous form of lung cancer that is very deadly and very critical. If you or someone you love has been given a diagnosis, the prognosis might not be good. However, one of the first things you should do with a Mesothelioma diagnosis is to find a good Mesothelioma lawyer, because when it comes to the symptoms, the fact is that there is usually, if not always, someone to blame for the Mesothelioma.

Many times if you find a Mesothelioma lawyer you will see that a settlement is very easy to reach, and a lawsuit can bring you the peace of mind that you need to move forward, as well as the money that you need to settle medical bills, take care of arrangements, and put your life back together if you have lost someone due to Mesothelioma.

In California, the best are going to be associated with the Johnson Law Group. This is simply put because the Johnson Law Group is going to help you handle your cases with the least amount of stress for you as possible. There are many things that you can do to make your transition easier, and the Johnson Law Group is going to be able to help you do all of these things.

Why is Mesothelioma So Serious?

The reason that this disease is such a deadly disease that it is a cancer that is mostly always caused by exposure to Asbestos. There are many people who have had exposure to asbestos and might not even know it. Many years ago, Asbestos was very popular in building materials and also in fire proofing. However, it was soon found out that Asbestos is actually very dangerous.

It is poisonous, and it was soon banned from use. However, not every building site or building rid the Asbestos from use. It was simply too expensive to get rid of all of it ,and some people did not do what the government had instructed. Unfortunately, this leads directly to many cases of Mesothelioma and to many different lawsuits.

The main thing that you have to know about Mesothelioma lawsuits in California is that you have been diagnosed with it or if you have lost a loved one or are dealing with a loved one’s sickness, most likely there is someone or some business that is to blame for this cancer. While this might be of little consolation to you, you have to understand that Mesothelioma is going to cost you a lot of money.

There are going to be huge doctor bills, and many other costs that are associated with Mesothelioma. A lawsuit as well as a settlement can help get you the money that you need to deal with these costs. No one wants to think about money when someone is very sick, but the bottom line is that most of the cases of Mesothelioma are due to someone not following regulations, or a building which was not up to code.
